These Terms of Use govern your access to and use of bellevuefarms.net (the “Site”), operated by Bellevue Farms (“Bellevue Farms,” “we,” “us,” or “our”). By using the Site, you agree to these terms. If you do not agree, please do not use the Site.

Information on this Site

We provide this Site for general information about Bellevue Farms, our breeding program, and horses or other animals that may be available. We try to keep listings, pedigrees, registration details, photographs, videos, prices, and availability accurate and current, but we do not guarantee that all information is complete, error-free, or up to date. We may correct or change Site content at any time without notice.

Listings and transactions

A listing, displayed price, or response to an inquiry is an invitation to begin a conversation and is not an offer, acceptance, reservation, warranty, or binding agreement to sell. Availability and pricing may change, and an animal may be withdrawn at any time.

Any purchase, deposit, reservation, breeding arrangement, transportation arrangement, or other transaction must be confirmed directly with Bellevue Farms and may be governed by a separate written agreement. You are responsible for conducting the inspections, veterinary examinations, registration checks, and other due diligence you consider appropriate before entering a transaction. If a separate written agreement conflicts with these Terms of Use, the separate agreement controls the transaction.

Inquiries and communications

When you submit an inquiry, you agree that we may use the contact information you provide to respond by your selected method or another reasonable method. Submitting an inquiry does not create a confidential, fiduciary, agency, partnership, or contractual relationship.

Acceptable use

You may use the Site only for lawful, personal, and noncommercial purposes. You may not:

• interfere with the Site, its security, or another person’s use of it;
• attempt to gain unauthorized access to the Site or its systems;
• submit false, misleading, abusive, or unlawful material;
• use automated means to scrape, harvest, or copy Site content without our written permission; or
• use Site content in a way that infringes intellectual-property, privacy, publicity, or other rights.

Intellectual property

The Site and its text, photographs, videos, graphics, logos, design, and other content are owned by Bellevue Farms or used with permission and are protected by applicable laws. You may view and share links to publicly available pages for personal, noncommercial purposes. No other license is granted. Please contact us before reproducing, modifying, distributing, publishing, or commercially using Site content.

Third-party services and links

The Site may link to or display content from third parties, including social networks, video providers, pedigree resources, and registration organizations. Those services are controlled by their respective providers and may have separate terms and privacy practices. We are not responsible for third-party content, availability, security, or practices. A link does not imply our endorsement.

To the fullest extent permitted by law, the Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied. We do not warrant that the Site will always be available, secure, or free from errors or harmful components. Nothing on the Site is veterinary, legal, financial, or other professional advice.

Limitation of liability

To the fullest extent permitted by law, Bellevue Farms and its owners, employees, and representatives will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, goodwill, or opportunities, arising from or related to your use of or inability to use the Site. Our total liability for claims relating solely to the Site will not exceed $100. These limitations do not apply where prohibited by law and do not alter liability expressly assumed in a separate written agreement.

We may update these terms from time to time. We will post the revised version on this page and update the effective date. Your continued use of the Site after a change means you accept the revised terms.

Governing law

These terms are governed by the laws of the State of Iowa, without regard to conflict-of-law principles. Any dispute relating to the Site or these terms must be brought in a court of competent jurisdiction serving Iowa County, Iowa, unless applicable law requires otherwise.
